An attempt to hear a case in which two Members of Parliament from Kiambu County contests decision by the area Governor William Kabogo to evict Madaraka Market Traders from their alleged location have been pushed to April.

Kabete Member of Parliament Ferdinand Waititu and Alice Ng’ang’a (Thika) claims that the matter is being dragged due to endless adjournments.

Justice Lenaola on Monday pushed the matter to April 12 on the grounds that some papers have not been filed.

Through their Lawyer Harrison Kinyanjui,the MPs moved to court seeking over Sh64 million as compensation from the county government for stall owners whose property was razed at the market.

The court had earlier extended a temporary injunction against the county not to interfere with the market until the dispute over ownership is resolved.

Lenaola had directed the MPs to serve Kabogo and the county government with copies of the petition.” Since the respondents have not received the copies of the application, I will not grant any orders at this point,” said Lenaola.

The two moved to court seeking over Sh64 million as compensation from the county government for stall owners whose property was razed at the market.

The court had earlier extended a temporary injunction against the county not to interfere with the market until the dispute over ownership is resolved.

Justice Joseph Onguto had earlier adjourned the matter since most of the lawyers were not present.
They want compensation of over Sh64 million with interests accruing from November 22, 2015 to date
The matter will be heard on Monday.

They are also seeking conservatory orders restraining Kiambu County Government from evicting the traders pending the hearing and determination of the suit.
The case will be mentioned on February 14 to set a hearing date.

The matter was fixed for hearing on 12 of April 2016.
