A State prosecutor has opposed an application seeking to institute private criminal proceedings against suspended social security agency boss and five others.

Senior Principal Prosecution Counsel Joseph Gitonga yesterday disputed the allegations made against the suspended National Social Security Fund (NSSF) Managing Trustee, Richard Langat, by the Central Organization of Trade Unions (Cotu).

Mr Gitonga explained that the Ethics and Anti-Corruption Commission (EACC) investigated and forwarded a file to the Director of Public Prosecutions (DPP) who said there was no evidence to warrant prosecution.

“EACC recommended that administrative action be taken against Mr Langat for exposing the fund to contractual obligations,” Gitonga told Chief Magistrate Daniel Ogembo.

The office of the DPP agreed with the EACC’s finding that the Tassia (II) project was a self-financing project and therefore NSSF funds were not to be utilized.

“In regard to Langat, the DPP found out that there was no requirement that before the contract was signed, all funds should have been collected from the tenants,” said Gitonga.

Recently, the suspended NSSF officials linked to Sh5.1 billion Tassia II project suit were granted more time to file their replying affidavit. The matter will be heard on March 31.
