A city landlady and an Auctioneer are now relieved after they escaped a jail term for disobeying a court order.

Esther Ikamba and Joseph Kimanti of pyramid Auctioneers are accused of selling Ceaser Warema Githinji’s goods despite a directive barring them to do so.

Justice Joseph Sergon directed Esther Ikamba and Joseph Kimanti of pyramid Auctioneers to settle the matter out of court.

Mr Githinji’s goods are said to have been sold on February 2, 2015 by auctioneer Kimanti at Eastleigh 5th street in Nairobi County.

Through his lawyer Munyalo Muli, Mr Githinji claims that his goods were auctioned despite the order that was issued on October 24, 2014 by the Chair of the Rent Restriction Tribunal.

The court found them guilty of breach of the orders.

The two were first ordered to appear in court on March 31, 2016 but Ms Ikamba was said to be unwell.

The lawyer added that the goods were sold by the two despite being informed in a letter dated January 21, 2015 to release the goods.

The merchandise includes, a Sony Tv, a wall unit, microwave and other household equipment.

Judge Sergon directed the parties to go and settle the matter out of court and record a consent. “I am not here to punish the lady but I would like the parties to settle the matter out of court failure to which you will come to me for further directions,” said sergon.

Ms Ikamba said in court documents that she was not aware of the order as the ruling was delivered in her absence.

Ikamba claims that Mr Githingi has failed to pay a rent of Sh 245,000. Githinji claims that he lost goods valued at Sh 700,000.The matter will be mentioned on April 28 for the court to confirm settlement.
