The Judicial Service Commission (JSC) has been asked to fast-track the removal of all Supreme Court judges.

A petition filed with the commission seeks to have Chief Justice Dr Willy Mutunga, suspended Judge Philip Tunoi, Justice Jackton Ojwang, Mohamed Ibrahim, Smokin Wanjala and Njoki Ndungu removed on account of breach of code of conduct prescribed for judges of the superior court by Parliament.

The petitioner Mr Isaac Aluoch Aluochier, says that the six judges violated the constitution by entertaining the presidential petition of 4 March 2013 general election which ruled in favour of President Uhuru Kenyatta.

He drew the attention of JSC, stating that on January 29 and February 1 2013, the IEBC conducted registrations of candidates for various elective posts, while being aware that the candidates it was clearing were still holding public office.

Mr Aluoch said that both IEBC and its nine commissioners under article 3(1) of the constitution were obligated to respect, uphold and defend the constitution which they didn’t.

He contends that the judges of the Supreme Court should have not entertained the presidential petition which arose from an illegal process caused by IEBC.

The petition will be placed before the JSC, heard and dispensed with.
