Jubilee legislators want Cord leaders Raila Odinga, Moses Wetangula and Kalonzo Musyoka stopped with their supporters from storming or forcibly removing IEBC officials from office.

The law makers also want the opposition barred from interfering with IEBC operations and to abide by the prescribed law in lodging any complaint regarding any of the commissioners currently in office.

They similarly want the court to issue a mandatory order compelling the Inspector General of Police Joseph Boinnet to ensure security, public safety, and the observance of law across the country.

MPs Ferdinand Waititu (Kabete), Moses Kuria (Gatundu South), Dennis Waweru (Dagoretti South), Kimani Ichung’wa (Kikuyu) and Alice Ng’ang’a (Thika town) also want the court to order the IG to arrest an Cord protestor breaching the law, engaging in destruction of private property, breaching peace or trespassing upon private or public property.

“Even though Cord claim to have reasons to oust the IEBC sitting commissioners, I have not seen any demonstrable fact that the IEBC has failed to uphold its constitutional and statutory mandate, such as would justify the removal of its commissioner as suggested, notwithstanding the failure to abide by the process of removal of such commissioners,” MP Denis Waweru says in an affidavit.

Ms Alice Ng’ang’a on the other hand says that she is concerned that Cord is driving the nation of Kenya to the brink of the mood and atmosphere that bred the 2007-2008 Post Election violence when at that time the mantra was “No Raila, No Peace”. She states, “The arising bloodshed is an issue of grave concern. I invite this court to peer into it as totally unjustifiable then, nor can it be now.”

Gatundu south MP Moses Kuria says that the only thing that has changed now with Cord is the phonetics of “No “reforms” of IEBC, No 2017 elections”. He deposed that the narrative was untenable, as the opposition ought to accept a democratic process; it has winners and losers always.

Moreover, as deposed to by my co-Applicant, MP Waititu says that Cord took part in the recent 2016 Malindi By-Election, which they not only accepted the results announced by the very same IEBC, but also celebrated the said results pronounced by the very same body.

“I have not seen anything credible in the public domain that exists to demonstrate that the IEBC has exhibited any lack of independence expected of such a Constitutional body in the preparation of the elections set for 2017, such as would give credence to the acts of the cited Respondents,” MP Waweru said.

The MPs said that the acts of incitement and arbitrary actions, and the propounding of bad governance principles that are occasioning economic losses to the nation and threatening the image of Kenya among visiting nationals, is something the court ought to consider as persuading it to issue the conservatory orders sought.

The high court certified the suit urgent, serve the petition through the media and appear in court tomorrow, April 29 2016.
