Orange Democratic Party (ODM) Ruaraka parliamentary seat aspirant accused of uttering words deemed as propagating hatred and likely to fuel violence has been arraigned.

A magistrates court has declined to have.. Detained in police custody pending further investigation of hate speech allegations.
He appeared before Magistrate nzakyo but did not plead to any charges.

The court released him on a cash bail of Kshs 100,000 Pending investigation into the case.

The prosecution was however opposed to his release on grounds that investigations are still going on but the magistrate said the state had not adduced compelling reasons to have him detained.

The learned magistrate declined to detain Ayungo 3days sought by the investigating officer saying he failed to give compelling reasons to warrant the detention of the respondent

He was brought to court under miscellaneous applications seeking to have Jim Clement Ayungo detained in police custody for three days to assist police with investigations.

The Magistrate further added that Ayungo should report to the Directorate of Criminal Investigations (DCI) headquarters when required.

He was arrested at Lucky Summer Area and after interrogation and he could not immediately give the motive behind his words.
“Wakijaribu kuiba Kura tutachoma hizi magari ya maji wameweka hapa” uttered Ayungo.
