A Nairobi court has Okayed the registration of a new teachers union.
It also directed the Registrar of Trade Unions to issue a certificate of registration to Kenya Teachers Congress within 14 days.
Judge Hellen Wasilwa of the Labour Relations and Employment Court issued the direction saying that the registrar’s decision was unreasonable and unjustifiable.
The registrar had argued that the applicants were not genuine in seeking to register the new outfit and that they are advancing selfish interests in a quest to destabilizing the labor sector and trade Unionism in the country.
The new Union General Secretary John Mbate welcomed the ruling saying it observed rule of law.
“We are happy with this ruling. It has been long overdue. We started off this Crusade in March last year.”
Mr Mate said that the decision to refuse their registration was discriminatory and ought to be quashed.
Kenya Teachers Congress told the court that they have fulfilled all the requirements for registration of a trade Union espoused in section 12 of the Labor relations Act.
Mr Mate also said that the union is intending to roll out a nationwide recruitment drive.
Kenya National Union of Teachers KNUT was also named as an interested party in the suit.
