A political aspirant for the Kibwezi West Constituency has been arraigned in Milimani law courts with charges of fradulently trying to sell a parcel of land.
James Kimathi Mbaluka pleaded not guilty to the charges of obtaining Sh10 Million from Rachael Kaki Nyamai by pretending he was in position to sell a parcel of land in Karen within Nairobi City County.
The Wiper Party parliamentary hopeful was released on a cash bail of 80,000 and a bond of 2million over a parcel of land he is accused of trying to sell. The land registered as LR Number 12302/8 is said not to be in his procession by the time he was selling it.
Mr Mbaluka through his lawyer pleaded with the Chief Magistrate Francis Andayi to defer the plea. “This matter is related to a commercial dispute before the high Court and there’s a ruling on how my client should pay the amount. My client has already paid 2million and is willing to settle the entire amount as per the ruling ” submitted the lawyer.
Despite the advocate saying there could be malice in the way his client was being charged in a criminal case, the magistrate dismissed the application. The court was told through the prosecution that there was no order from the superior court staying the proceedings from magistrate court.
“There’s no compelling reasons adduced by the defense to enable this court to differ the plea and I direct the accused person to take the plea” magistrate ruled.
