The Nairobi County Government now wants the court to suspend a directive it  issued last week barring the County from evicting hawkers operating within Eastleigh.
Lawyer Tom Ojienda, argues that the county is heavily prejudiced for it is unable to carry out its respective Constitutional functions.
Prof Ojienda claims that hawkers have made it impossible for the county government to collect revenue from business permits and licenses since hawkers do not pay for them.

Yesterday Shops in Eastleigh were closed following protests by shop owners against the court order that reinstated hawkers on the streets.
“The irrational order has made shop owners operating from legally designated business areas located within the area to shut down as buyers have opted for cheaper option from the hawkers,”argues Ojienda.
The applicant claims that the presence of hawkers has led to disruption of shop owners businesses which have caused entanglement between the two leading to unprecedented rates of insecurity in the area.
