DPP WITHDRAWS ASSAULT CASE AGAINST ALLIANCE HIGH SCHOOL STUDENTS.

The assault case involving six Alliance High School has been withdrawn after the complainant and the accused agreed to solve the matter out of court.
Appearing before Kikuyu Law Courts Senior Magistrate Daniel Musyoka. the six form 4 students were asked to go back to school and continue with their studies.
The six Form 4 students had been accused of unlawfully assaulting and injuring their fellow form four student.
Last month Alliance High School Principal David Kariuki applied for early retirement following allegations of bullying at the school.
The case was fixed for the mention on 16th March, however the case failed to proceed after parties approached the court with a view of making an application to be allowed to withdraw the matter.
The case came for mention on Thursday before Kikuyu Senior Principal Magistrate Daniel Musyoka  and defense indicated to the court that parties had reconciled and wanted to withdraw the matter.
Prosecutor objected to the application to withdraw requesting the matter to be mentioned after two weeks so that she could get directions from the DPP and DCIO Kikuyu but the court over ruled quoting several sections of the constitution in respect to reconciliation and rights of a child as per the  children act.
The learned magistrate said all the six accused are persons protected by the children act and allowed the withdrawal of the criminal case against the students under section 204 of CPC.
They were out on a cash bail of Kshs 20,000.
