A passenger has sued an airline after a flight attendant poured hot beverage on her thigh.

Rebecca Mulongo Wanyonyi, 30, is seeking compensation over that unfortunate incident.

She says that she sustained burn injuries on her thigh.

Rebecca sued Jambo jet for negligence saying the airline has to take responsibility of its workers whom she alleges without due care poured hot tea on her right thigh causing her second degree burns which cost her a lot of money to treat.

In a civil suit before a Nairobi Employment ,Labor and relation court, through her lawyer Daniel Achach, Rebecca says that on August 22, 2016 while she was lawfully aboard Jambo Jet from Nairobi Jomo Kenyatta International Airport to Mombasa Moi International Airport, a male Cabin crew attendant negligently and without due care poured a hot beverage on her right thigh which caused her pain.

Lawyer Achach has based the particulars of the case that the airline is negligent for failure to take due care for the well-being of the passengers on board the flight, and failure to provide precautionary measures, therefore the airline is vicariously liable for the actions of its employee.

He says despite his client raising the matter with the company, she has been ignored completely.

“Despite demand and notice of intention to sue, the defendant has failed, refused and or neglected to admit liability and compensate  the plaintiff,” he says.

As a result of the unplanned incident, Rebecca wants the court to compel the airline to pay her special damages amounting to Sh213, 600 general damages, accrued from Sh200,000 Medical expenses 10,500 taxi expenses, 3000 medical report and Sh100 for police abstract.

She also want unspecified amount for pain and suffering, Interests on damages and the cost of the suit.
