The government now claims that it is not aware why lawyer Miguna Miguna was not in the country, hours after the controversial lawyer announced that he was aboard a flight to Kenya.
Responding to the latest application filed by Miguna through his lawyer John Khaminwa, the government said Miguna has not demonstrated how has been denied entry.
Through lawyer Christopher Marwa, the government told high court judge Weldon Korir that they were not behind the tribulations of Miguna and were willing to facilitate his return back to the country.
He urged the court to dismiss the application, saying it has no basis. “Miguna Miguna has not said whether the Government has refused to allow him back to the country,” said Marwa.
The Court heard that Miguna was in another country where Kenya has no control of and if his travel documents are processed, he can come back to the country.Khaminwa said that Miguna is in a foreign country and it is the government responsibility to facilitate his coming back.
He further said that he spoke to interior CS Fred Matiangi who assured him he is not opposed to Miguna’s entry into the country adding that his client has not been able to come back because of the red alerts allegedly issued by the authorities.
Justice Weldon Korir gave the government until tomorrow to file its responses and appear for inter-party hearing on Friday this week.
