OMTATAH CHALLENGES REINSTATEMENT OF MAASAI MARA DVC.

Activist Okiya Omtatah has challenged the reinstatement of Prof Mohamed Abdile as the Maasai Mara University’s Deputy Vice Chancellor.

According to the Activist, the decision made by the University Ad Hoc appeals Committee to hear Prof Abdile’s appeal, was wrong because it was filed out of time.

Further, he has challenged the move by the University’s appeal committee not to refer the matter to the Public Service Commission, which he said has jurisdiction to sit on appeal over such decisions of the Council.

And the move to constitute an ad hoc appeals committee, to determine the appeal was illegal. He is aggrieved that the newly installed Council of the University decided to reinstate Prof Abdile, who was summarily dismissed by the immediate former full council for gross misconduct. 

He faults the reinstatement process for being devoid of merit to the extent that the university committee has no jurisdiction to entertain an appeal.

Omtatah argue that Maasai Mara University Council lodged his appeal on May 3, 2020, some 59 days after his summary dismissal on March 5, 2020.

He said the law under Section K.10 of the Public Service Commission’s, human resource policies and procedures manual for the public service, provide for lodging of the cases within 30 days.

 He also said Prof Abdile’s appeal was lodged 42 days after his dismissal contrary to the very clear provisions of Paragraph 3.31(e) of the Maasai Mara University human resource policy which requires that a member of staff who is not satisfied with the committee’s verdict may appeal to the appeals Committee of the University Council within a period of fourteen (14) working days.

“A member of staff who is not satisfied with the committee’s verdict may appeal to the Appeals Committee of the University Council within a period of fourteen days (sic) (14) working days”, it states.
