Two security employees attached to Sarova Stanley hotel have been charged with an authorized intercepting a CCTV footage capturing President Uhuru Kenyatta and opposition leader Raila Odinga entourage along Kenyatta Avenue.

The footage of the two leaders, on June 2, showed them inspecting walkways being done by the Nairobi Metropolitan Services (NMS).

The court heard that Janet Magoma Ayonga and Patrick Rading Ambogo intercepted computer data intentionally and without authority.

They appeared before Milimani Senior Principal Magistrate Bernard Ochoi and denied the charge but their lawyers Danstan Omari and Apollo Mboya said they will demand a statement from the head of state and Odinga.

Lawyer Omari told the court that the only complaint can be the hotel and not the state and the presidential entourage did not have the presidential standards or the coat of arms nor police sirens. “Is it the first time people are recording president Uhuru?” he posed.

“We demand the president and Raila to record statements we cross-examine him,” added Omari.

Omari said the charge sheet was an abuse of the criminal justice system and the Director of Public Prosecution should recall the file and terminate the charges before it brings dishonour to the office of the president.

The two are accused on June 2, at around 20:20 hours in Nairobi, within the Central business district, jointly and intentionally and without authorization intercepted a CCTV footage capturing President Kenyatta and Odinga’s entourage on Kenyatta Avenue.

The court ordered them to deposit cash bail of Ksh10,000 each, to secure their release. The case will be mentioned on July 2 for further directions and the prosecution has listed three people listed as witnesses.Show quoted text
