Two former Kenya Sevens rugby players have been charged afresh with gang raping a woman two years ago.

Frank Wanyama and Alex Olaba pleaded not guilty to two counts each, and the court released them on cash bail of Sh300,000 each, despite protestations from the prosecution.

Last week the High Court declared the case a mistrial after It emerged that the complainant was not sworn as required by law, before she testified. The two, who had already spent 10 months in prison, had been sentenced to 15 years imprisonment each, for gang-raping the woman at Wanyama’s apartment in Highrise in 2018.

According to the charge sheet, the two are alleged to have committed the offence on February 11, 2018 at Seefa apartment in High-rise in Nairobi County.

While granting them cash bail, the court noted that it is not bound by the previous proceedings. The magistrate, however noted that they face serious charges.

The court directed that the case be mentioned on July 21, for purposes of fixing a hearing date. The Magistrate further warned the duo against interfering with witnesses lined up in the case, lest the bail terms be cancelled.
