COURT BARS LSK BOSS HAVI FROM REMOVING CEO MERCY WAMBUA.

Law Society of Kenya (LSK) President Nelson Havi has suffered a major blow in his attempt to remove CEO Mercy Wambua.

The Employment and Labour Relations Court issued orders restraining Havi and the council of LSK from removing Wambua, pending the determination of a petition she has filed.

Justice Nzioki Wa Makau further barred Havi from enforcing and or purporting to enforce LSK’s decision on October 19, 2020 and subsequent notice allegedly terminating Wambua’s services as LSK secretary.

“Pending the hearing and determination of the petition, a conservatory order is hereby issued restraining the Respondents and or their agents, servants, employee, nominees or any other person whosever acting at behest of the 1st Respondent to, from interfering with the Petitioner’s role as secretary to the Law Society of Kenya and from interfering with her position as the Chief Executive Officer of the Law Society of Kenya,” the Judge said.

The court said no one should interfere with Wambua’s day-to-day administration, management of the LSK secretariat and the affairs and functions in any manner whatsoever interfering with her contract of employment.

The court further restrained Havi and the council of LSK from publishing or causing to be published, posting or reposting in any print media, social media or any information regarding Wambua’s employment status and terms of service or making any disparaging remarks regarding her employment.

Havi had in a letter dated November 23 said a Special General Meeting on December 5, 2020 resolved to remove Wambua as the CEO over allegations of not enforcing the body’s resolution and alleged financial impropriety.

Wambua said her tenure was extended for another three years from March 1, 2019, until February 28, 2022, ostensibly in line with the provisions of Section 26 of the Law Society of Kenya Act, 2014.
