COURT STOPS PLANS TO ARREST, CHARGE MERU SENATOR LINTURI WITH 38 COUNTS.

High Court has rescued Meru Senator temporary from arrest and Prosecution over claims that he forged signatures to secure a Sh530 million bank loan using properties belonging to his estranged wife Marianne Kitany.

Justice Weldon Korir issued the conservatory orders barring the DCI and DPP from arresting Linturi and his business partner Emily Nkirote over 37 fraud-related criminal charges.

“l hereby issue an order of prohibition restraining Director of Public Prosecution and Directorate of Criminal Investigations from arresting, charging and or prosecuting the Applicants with any criminal offences relating to or revolving around the credit facilities and securities as well as the fraudulent changes on Atticon Limited ownership and control pending the full hearing and final determination ” ordered Korir.

Justice Weldon Korir issued the order On Tuesday after Linturi complained that the arrest and prosecution was meant to intimidate and coerce him to abandon his known stand on various political issues.

Senator Linturi also submitted that the move was meant to give his estranged wife an undue advantage in the ongoing civil and commercial cases pending before various courts.

“The petitioners are afraid that his right to fair trial will be jeopardized by their intended arrest, charge and prosecution for alleged offence revolving around the credit facilities extended to the 3rd petitioner on the strength of securities provided by the 2nd interested party as well as fraudulent changes of directorship, shareholding and share capital of the 3rd petitioner,” he said.

The senator and Nkirote were expected to be charged at the Milimani Law Court on today (Wednesday) to face the criminal charges after the police completed investigations into the matter.

The order comes after Linturi was interrogated at the Directorate of Criminal Investigations headquarters on April 28 after he was arrested during the debate on Building Bridges Initiative (BBI) Bill at the senate while his business associate Nkirote recorded her statement on November 1,2018.

This is the third attempt by Mr Linturi to rush to court seeking protection saying there are plans to arrest them yet the matter is being handled through ongoing civil cases pending before various courts pitting him and his estranged wife. His lawyer claimed Linturi was alerted of the planned arrest by one of his staff after some documents were dropped at his office, among them a draft charge sheet containing 38 counts.

The charges, he said include giving false information, obtaining credits by false pretenses, personation, abuse of office and fraudulently procuring the registration of charge documents.
