Employment and labour Relations court has ordered the reinstatement of a police officer who was unlawfully sacked almost three years ago.
Justice Maureen Onyango directed the National Police Service and the Inspector General of police to reinstate Maxwell Onduso, who was sacked in November 2017. The court said the officer should be reinstated to his rank or position, without losing any benefits.
In a judgment on July 27, Justice Onyango said the officer was unlawfully sacked.
The aggrieved officer through his lawyer Stephen Mogaka moved to court seeking a declaration that the employer contravened section 4 of the fair administrative action act by suspending and later dismissing him.
He sought an order to quash the decision to suspend him on November 1, 2017 through lawyer Steve Mogaka.
The lawyer argued that the petitioner was not given a chance to defend himself on allegations made against him.
