The family.of the late tycoon Tob Cohen has sought to join a petition in which Court of Appeal judge Sankale ole Kantai has filed a case to block plans to re-arrest him.

The family through Cohen’s sister Gabriel Hannah Van Straten, says it is important that they take part in the proceedings.

Justice Kantai has already obtained orders to stop his arrest and possible prosecution in conni with the killing of Cohen.

Lawyer Danstan Omari, says that Justice Kantai having been previously arrested by officers from the criminal investigation was questioned and made a statement.

And after careful analysis a recommendation was made to the DPP to charge him.

But when he perused the file, the DPP concluded that there was insufficient evidence to prosecute the Judge and consequently ordered the file closed.

Omari alleges in the application that the DPP directly protected the judge and othe prominent persons involved in the murder of Cohen.

The late Cohen was a citizen of Holland and Israel and his mysterious murder was taken seriously by the government of Kenya in order to keep up the good relationship with diplomatic countries.

The lawyer pointed out that not only the DPP discharged the Judge he has several pending files from the DCI in which recommended for the prosecution of the suspects, the DPP has not acted today.

Lawyer Omari hinted that he will be filing a petition next week seeking to remove the Dpp from office for failure to perform his duty as per the law established.
