A hospital has been directed to release a patient who has been detained over non payment of medical bills.

High Court Judge James Makau stated that it was illegal to detain a patient adding that the patient ought to be allowed to return home.

The family through Atuti Nyangoro had requested the hospital to allow them deposit Sh200,000 and pay the balance through instalment.

However, the hospital declined seeking full payment before the recovered patient can be released.

Lazarus Oreko has been in the hospital for the past three months.

The Labib hospital ltd, which is seeking full payment of Sh730,000, has been served with the order.

It is expected to file response ahead of the mention set for November 16.
