A co-director of the popular city restaurant facing charges of fraudulently obtaining Sh520 million from a local bank has been released on bail.

Nina Jayesh Shanghavi was released on a cash bail of Sh400, 000 and alternative bond of 1 million pending hearing and determination of over half a billion fraud.

Milimani senior resident magistrate Wandia Nyamu also ordered Nina to deposit her passport in court and never to leave the country without permission from the court.

Nina produced herself in Court on Tuesday after the court issued a warrant for her arrest. She was remanded in custody awaiting a ruling on her bail application.

Her attempts to remain at the city hospital were declined by the magistrate saying she was now under custody of the state and no way she could be remanded in a private hospital. The court had directed her to be held at Kenyatta National Hospital after she claimed she was unwell, under the supervision of the in charge of Lang’ata Women prison.

Nina, the husband Jayesh Shanghavi and Good Earth (Group) ltd are accused of inducing Victoria Commercial Bank ltd to execute First Legal Charge over agreement Number B2 erected on land reference Number 1870/11/253, Nairobi (Crystal Edge Apartments) to secure Sh520, 000,000 million as valuable security.

They allegedly committed the offence jointly with others not before court, between December 10, 2018 and November 23, 2020 in Nairobi.

The case will be heard on February 3.
