COURT FREEZES FOUR LUXURIOUS VEHICLES OVER LINKS TO DRUG TRAFFICKING CLAIMS.

Two men facing charges of drug trafficking have been prohibited from selling or transferring four cars among them two luxurious vehicles.

High Court Anti-Corruption division Judge Dorah Chepkwony prohibited Dida Jarso Ache and Yusuf Halkano Sokono from selling or transferring the vehicles including a Toyota Land cruiser, Mercedes Benz Actros, Toyota Ractis and Toyota Probox pending hearing and determination of the case filed by the Asset Recovery Agency (ARA).

“A preservation order is hereby issued prohibiting Respondents from transferring or selling Motor vehicle registration number KCU 348H Toyota Land Cruiser, registered in the name of Grace Mbinda, KCW 835N Mercedes Benz Actros, registered in the name of Jarso Dida, KCS 906G Toyota Ractis, registered in the name of Florence Kimeu and KCN 112H Toyota Probox registered in the name of Samwel Maobe pending determination of the petition,” the Judge ordered.

Others prohibited from dealing with the said motor vehicles include Florence Kimeu, Samwel Maobe, Jarso Dida and Grace Mbinda. The court ordered them to surrender the original logbooks of the motor vehicles, and the vehicles to ARA or the Directorate of Criminal Investigations along Kiambu, within seven days.

Justice Chekwony also directed the Director General of National Transport and Safety Authority to register a caveat against the records of the motor vehicles.

The agency said in the petition that the vehicles are suspected to be proceeds of crime. This is after allegedly receiving information into suspected trafficking of narcotic drugs and money laundering involving the Respondents from the DCI.  

The suspects were charged before the Chief Magistrate’s Court at JKIA with the offence of trafficking in narcotic drugs contrary to Section 4(a) of the Narcotic Drugs and Psychotropic Substances which is pending before the court.

The Respondents were arrested on May 29, 2020 along Sagana Nairobi Highway near Kakuzi Farm and found in the possession of 10 sacks of dry greenish plant material while driving motor vehicle registration KCU 348H Toyota Land cruiser Pickup and at the time of the arrest, the arresting officers also recovered Sh183,000 in cash from them.  

On June 6, 2020, the Respondents herein was charged  before the Chief Magistrate’s Court JKIA for the offence of trafficking in narcotic drugs and the packages of the dry greenish plant material were taken to the government analyst who confirmed them to be narcotics under the Narcotic Drugs and Psychotropic Substances (Control) Act No. 4 of 1994.   

“Preliminary investigations have established that Ache through the 2nd Interested Party purchased motor vehicle registration number  KCU 348H Toyota Land cruiser Pickup from Musa Yusuf Mdose who had purchased it from Grace Anyona Mbinda who is the registered owner,” the agency said.  

But in his statement to the police Ache admitted to having been involved in the drug trafficking case for three years prior to his arrest and to owning a fleet of vehicles.
