A public spirited litigator Memba Ocharo wants businessman Jimmy Wanjigi restrained from further attacking President Uhuru Kenyatta or opposition leader Raila Odinga when he is required to comply with basic procedures of independent Institutions.
Ocharo says Wanjigi has a habit of attacking the two leaders and linking his woes to politics whenever he is asked to comply with certain directives.
In an affidavit filed in court, Ocharo says Wanjigi should comply with the directive and return the firearms as ordered by Director of Criminal Investigations George Kinoti.
Kinoti wrote to businessman Wanjigi ordering him to surrender the illegal firearms in his possession.
Through Kuriah Obadiah, the DCI boss said Wanjigi does not have a firearms certificate hence the guns in his possession are illegal.
“You are therefore required to surrender the under listed firearms and ammunitions to the under-designed at DCI Headquarters, Mazingira Complex, Kiambu road within 72 hours from the date and time of delivery of these summons,” Wanjigi ordered.
According to papers filed in court Ocharo argues that Wanjigi’s conduct has previously been questionable while in possession of firearms.
Through lawyer Danstan Omari, the activist says that Wanjigi posses a grave danger and risk to the members of the public as no one citizen should have in their custody 688 ammunitions and about 11 guns.
He is seeking a declaration that the Inspector General or Police Hillary Mutyambai and Kinoti are duty bound to provide security to members of the public and legally under an obligation control the licensing of civilian firearms.
It is his argument that the two can revoke Wanjigi’s firearms certificate number no. 9522 pursuant to section 23 of the firearms Act of justifiable grounds and in compliance with the rules of natural justice as decreed by Justice Mativo.
