A city lawyer has written to Director of Public Prosecution Noordin Haji seeking information about the hiring of senior counsel Taib Ali Taib to offer legal services in a constitutional petition pending before the High Court.
In the letter to the DPP, Lawyer Danstan Omari also wants to be supplied with contract hiring Taib to represent him in a petition challenging a complaint filed for the removal of Haji from office.
“We hereby request for information demonstrating your compliance with section 30(2)of the Office of Director of Public Prosecution Act number 2 of 2013 in the engaging of Taib A Taib Advocates. For the avoidance, we wish to receive information from you in not more than seven days from today on when and where the need to have a private legal law firm prosecute the petition numbers E037 of 2021 now consolidated and referenced as constitutional petition Number E334 of 2021”, Omari request.
Omari also seeks to be furnished with the contract of such engagement and the list of the total number of the firms that bidded for such a services, if at all.
Moreover, Omari adds that it is with his knowledge that Taib, SC was gazetted as special prosecutor.
He says under Article 157 of the Constitution obviously informs them of the limit of such exercise of prosecutorial powers and it is against this back drop that they would also wish to understand the circumstances leading to his appointment as a counsel litigating in the constitutional court for and on behalf of the Office of the DPP.
