Senior counsel Ahmednasir Abdullahi has sensationally claimed that the Judicial Service Commission as currently constituted is a department in the Office of the President.

While criticizing the ongoing interviews for the judges of the Court of Appeal, the veteran lawyer termed the recruitment as a sham, fake and total fraud.

He claimed in a tweet that the six candidates set to be appointed to the second highest court in the country were long agreed upon.

“I feel extremely sorry for judges of the High Court who applied for the six positions…the DEEP STATE already gave certain members of the JSC the acceptable & unacceptable lists…most candidates are then given a token interview & graded btw 10-15%,” he tweeted.

The former Law Society of Kenya president challenged the commission to openly share with Kenyans the marks for all the candidates so that they can judge for themselves whether the process is legitimate or ought to be cancelled.

Ahmednasir also said Chief Justice Martha Koome is rushing the process ahead of the August 9, General Election.

“As the immediate former Chairman of the Senior Council Committee of the Law Society of Kenya I call upon the Judicial Service Commission to stop forthwith the fake, sham and illegitimate interviews the Commission is conducting for the 6 positions of the Court of Appeal,” he said.

The advocate said the process doesn’t meet the mandatory test of Article 10 of the Constitution and is compromised from the start.

He also claimed that a majority of the commissioners are captives of the executive and the six candidates to be appointed by the commission have been agreed upon outside the commission.

Lawyer Omwanza Ombati said it was unacceptable and as he threatened to file a suit to compel the JSC to reveal the criteria being used and make it public including the marks.

“Allowing NIS and Office of the President to choose for us judges is an incredible low. State capture is a NO, NO”, Tweeted Omwanza.
