MAN CLAIMING OWNERSHIP OF CONTESTED LAND IN WESTLANDS DENIES ROBBERY WITH VIOLENCE CHARGE.

The director of Lariak Properties limited a company alleged to be behind demolition of a house in Westlands has been charged with robbery with violence.

Nathaniel Kipkemboi Barmasai appeared before Milimani Chief Magistrate Wendy Kangedo and denied the charge.

Prosecution told the court that Kipkemboi being one of the directors of Lariaki Properties ltd jointly with others not before court robbed Niraj Batuk Shah and Avan Niraj Shah their properties. It is alleged that he committed the offence on November 4, 2022 at Westlands school lane area in Nairobi county.

According to charge sheet produced in court by prosecution, the valuables include electronic appliances, jewelleries and assorted household goods all valued at Sh18,097,000 million.

The charge sheet further indicate that immediately after stealing the property worth over Sh18 million, they threatened to use violence against the said elderly couple residing in the demolished house.

He was released on a cash bail of Sh2 million and a bond of Sh3 million.

Embattled auctioneer Zachariah Baraza who alleged to be involved in the said denied any involvement in demolishing the said property adding that he was executing a court order.

However, Environment and Land Court Judge Oscar Angote found that the alleged court had not directed any demolition or eviction.

The judge summoned Baraza to appear in court on Thursday afternoon for mitigation and sentencing after he found guilty of contempt of court.
