DPP OPPOSES PLEA BY OFFICER FACING DEFILEMENT CHARGES TO BE FREED ON BOND.

Director of Public prosecutions Noordin Haji has opposed an application to release on bond a police officer accused of defiling a minor.

The Narok-based police officer, who is staring at spending not less than fifteen years in prison if found guilty for defiling the minor, has applied to be freed on bond pending the determination of his trial.

But senior prosecutor Duncan Ondimu wants 50 year old police corporal Anthony Nanyokie to remain in custody until the conclusion of the case.

The prosecutor told the court the accused is at flight risk and should remain custody during the entire trial. He added that the investigators and prosecution are ready to expedite the hearing of the case.

“There are compelling reasons to warrant the detention of the accused person pending hearing and determination of the criminal trial and the court must take judicial notice of increased defilement incidences within Narok County, which has caused huge public interest and apprehension,” Ondimu told the court.

The investigating officer Inspector John Kamau told the court that the accused person has since been interdicted.
However, key witnesses are police officers and neighbors to the suspended officer hence a close nexus to the witnesses, which increases the chance the chance of interference.

“The witnesses in the case are vulnerable witnesses due to the manner in under which the offence and the circumstances under which the offence was committed, there is likelihood of interference of the witnesses and the conduct of the case,” investigating officer told the court.

He want the Nanyokie who was officer on duty at Sakutek police on December 2 when the 16 year old minor was brought to the police station pursuant to a missing person that was lodged by her mother.

An affidavit filed in court says the accused forcefully picked the victim from the cell around 1 pm and defiled her then returned her back to the cells.

At around 4pm the accused again picked the victim picked the victim from the cells and directed her to cook a meal and wash the utensils later returned her to the cells.

“At around 7:30 pm, the accused again picked the victim from the cells and took her to his house where a knock by a fellow police officer who wanted keys to the cells, the accused ordered her to hide under his bed as he was opening the door. He then left the house immediately,” Inspector Kamau told the court.

Narok magistrate Phyllis Shinyada heard that when the accused came back, he directed the victim to go the neighbor’s house where she did not stay for long, the accused picked her up and took her to his house where he defiled her again that night.

Prosecutor Ondimu told the court that during the time the accused was defiling her, he applied threats and intimidation to execute his criminal acts. The victim was returned to the police cells at around 5:00 am on December 3.

The court will rule on the matter on December 21.

NairobiTIMEZ has learnt that the officer has been interdicted through a letter dated 5th December 2022.

The Narok County Sub-County commander Frederic Kinaibei informed the officer that he was interdicted effective date 5th of December pending hearing and determination of the case.

“Under powers conferred upon me by Cap 30 Section 47 (1) (2) and 3, I interdict you Cpl Anthony Nanyokie Leteipa from duty with effect from 5th December 22 pending the outcome of the court proceedings,” stated the interdiction letter.
