The investigating officer into the multi-billion Anglo Leasing scandal was taken to task over who recommended officials charged with the scam.

Former government officials including permanent secretaries Dave Mwangi, Joseph Magari, David Onyonka and businessmen Rashmi Chamanlal Kamani, Deepak Kumar Kamani, Chamnlal Kamani, and their companies are on trial into the scam.

The investigating officer John Kiiru could not explain why he chose to fault the legal opinion made by the Attorney General over the contracts to install security equipments for the police.

Defence lawyers Edward Oonge and Caren Sadia questioned the officer why he chose to charge the accused persons when the decision to award the contract was made by the government.

The lawyers showed the officer documents that sanctioned gave authorisation the procurement of the equipment.

They wondered how Magari was charged yet he acted on a legal opinion of the then Attorney General.

The officer could not explain how the government officials conspired with the businessmen.

The authorisation for procurement was done by former minister (now deceased) David Mwiraria.

The court heard that from Auditor’s General report of 2003/4 financial year did not indicate any misappropriation of public funds so as to form criminal charges against the accused persons.
