SECURITY GUARDS NARRATES HOW HE WAS ASSAULTED BY FORMER MP.

A security guard has narrated how he was assaulted by former Tetu MP James Ndung’u Gethenji, while on duty.

Godfrey Kirimi Mutua told Milimani Magistrate Muthoni Nzibe he was assaulted by Ndung’u on February 5, 2021 while on his normal duties and still leaves with the pain.

Ndungu is charged that on February 5, 2021 at Kihingo Village, he assaulted Kirimi thereby occasioning him actual bodily harm.

Kirimi said he currently work with FAPCL group that deployed him to work at Kitsuru Estate working as a security officer based at Kihingo village Kitsuru Westlands Sub-county.

He said that on the day of the incident, the former MP came holding his gun.
“I asked him why he was holding a gun today and we normally open for you,” the witness said.

Kirimi said Ndung’u came out of his car and started assaulting him together with his body guards and they were also shouting.

“He hit me in the face with a pistol as the bodyguard cocked his gun, as Ndung’u shouted that I should know people,” he said.

He added the police officers together with other guards came in following the commotion.

Kirimi says he supervise Securex security guards who manage Kihingo security and during the incident, he was acting on the order from the management to check on all the vehicles.

The witness said that Ndung’u came driving a Toyota Vanguard and as he approached to check who was inside the car, but he (Ndung’u) came out shouting and assaulted him.

He reported the matter to his bosses who advised him to report to Gigiri Police Station. “I later went to MP Shah Hospital for treatment,” said Kirimi.

Kirimi was cross examined by Lawyer Willis Otieno and Ishmael Nyaribo who wanted him to produce his job identification card and work permit.

He told the trial magistrate that, during the fateful day,the accused person assaulted him on the head causing serious injuries that led him to have several stitches.

Kirimi also identified Ndung’u as the one who assaulted him. When he was asked whether he knew that there were differences between directors, Kirimi told the court that they were employed by the directors but by then he didn’t know that there was war and division among the directors.

About him communicating and receiving money from some of the directors who are at war over the ownership of the company, Kirimu told the court that he only talks to some of the directors on job related issues and nothing more.

CCTV footage of the case will be played in court at a later time. They were never played in court because of time.

“I went to MP Shah Hospital for treatment, including stitches on injuries, I was also given a P3 form to fill,” he added.
He said that he has never had a difference with the accused person. He also identified the firearm that was used to hit him.

The firearm that was used was also produced in court. The matter will continue on May 14, 2023.
