The owner of the disputed parcel of land in Lavington has lashed out at the office of the Director of Public Prosecution {DPP} and the Director of Criminal Investigation{DCI} over the failure to prosecute a 75-year-old man for alleged land grabbing.

Addressing the Media at Milimani Law Courts, Munir Ahmed Chaundri and his late wife Malkiat Singh Assi, through their lawyer Moses Mabeya said they own the Lavington property.

And despite complaining about the land grab and investigation having been conducted, the accused persons were yet to be charged.

Mabeya further stated that Chaundri and Assi have owned the property for the past 50 years and a couple claiming ownership had no right over the land.

The lawyer said the DCI had also confirmed that the couple demolished a wall of the property and recommended to the DPP that Mahesh Kumar Bhatti and Anita Bhatti were to be charged on August 21.

Mabeya said they appeared in court for the case but were disappointed when the accused left with an unknown person.

Bashir Abdulrehman, an agent of the said property also confirmed that he has documents confirming that Chaundri and Assi are the legitimate owners of that property.

“The exact owners of the property are Mr Munir Ahmed Chaundri and the late Malkiat Singh Assi, and we have documents to show which we have shared with the media. The widow of the late is residing in the UK they are old people they are ailing’’, said Abdulrehman.

He further stated that Chaundri, who is in the hospital, confirmed that the property was his as stated by the agent through a video clip recorded and sent via WhatsApp.

‘’Iam still alive and iam recording this video from the UK, to inform you that I purchased the plot together with my partner Malkiat Singh Assi in 1977 and started construction the same year and completed in 1979. Lived there for a while, then rented November 1984 to TM-AM and made a deal with the company’’.

The DCI denied claims of unlawfully arresting an elderly couple at Lavington estate after they were caught in camera handcuffing two disturbed individuals.

Bhatti, his wife and their children insisted they have been residing on the property for more than 30 years.

They claimed that their home was raided by unknown people who started fencing the land without consultation.

The DCI issued a statement on Sunday detailing the facts of the case.
According to the DCI, a complaint was made by Chaundri on 28th February 2023 stating that he is the registered owner of land that was being claimed by Bhatti and Anita.

Investigation confirmed that Chaundri and his partner Assi jointly bought the land on 21st July 1971, the DCI said in the statement.
