Charges against a businessman accused of defrauding former commissioner of lands Sammy Mwaita of a parcel of land worth Sh50 million has been pushed to another date.

Milimani Chief Magistrate Susan Shitubi agreed to defer the plea against Howard Mugambi Mururu, following an application by his advocate Joseph Mutava.

Mururu had been brought to court to face charges of conspiracy to defraud Mwaita of a parcel of land and obtaining registration by false pretenses.

Mutava informed the magistrate that another matter, relating to the land in dispute, is pending before Environment and Land court.

He said Mururu obtained court orders restraining Mwaita from interfering with the said land.

Lawyer Mutava told the court that Mwaita is the first defendant in the matter and he was using the criminal charges to intimidate his client.

He added that Mururu transferred the disputed property from his company Mari Properties limited.

According to the charge sheet, Mururu is accused of conspiring to defraud Mwaita the land worth Sh50 million .

The charge sheet stated that he conspired to fraudulently register a parcel of Land L.R. No.13791/3 by falsely pretending that his company Mari Properties ltd owned the land.

It is alleged that he conspired with others on or about the 17th day of December 2021 at Ardhi House.
