A businessman who is negotiating with Director of Public Prosecution to testify against city businesswoman in Sh100 million fraud has been charged.

Peter Gathii Reuben denied he illegally procured the registration of a parcel of land in a bid to defraud a family of a parcel of land worth Sh100 million when he appeared before Milimani Principal Magistrate Ben Mark Ekhubi.

The charges stated that Gathii willfully and unlawfully procured the registration of land parcel in Pangani area valued at Sh100 million belonging to the late Bertha Wamina Mugo.

It is alleged that she committed the offence on diverse dates between 21st February, 2014 and 23rd June, 2022 at Ardhi House, jointly with others not before court.

According to the prosecution, Gathii told the land registry that she was the sole rightful proprietor of the said parcel of land hence the right to acquire its title.

The accused was also charged with falsely pretending that he had bought the said parcel of land from Mugo, before her demise, with the intention of defrauding Mugo’s family of the land.

Gathii was further charged with making a letter of Allotment Ref: 33043/69 for parcel of land No. L.R. 209/2389/19, without authority from the original owner, purporting it to be a genuine letter of allotment issued by the National Land Commission.

Gathiu was released on a bond of Sh10 Million or an alternative cash bail of Sh3 Million.

The matter will be mentioned on the 3rd October for consolidation with the others charged before him.

He told the court he is negotiating with DPP to become a state witness.

If prosecution give greenlight, he will testify against businesswoman Catherine Njeri Ng’ang’a who was charged last week.
