Two lobby groups have challenged a decision of the High Court cancelling the 2019 population census results for three counties in the former North Eastern Province.
African Institute for Peace and Human Rights, lawyer Lempaa Suyinkaa and Kenneth Njiru filed a notice with intention to overturn the judgement by High Court judge John Onyiego.
In a judgement last week, Justice Onyiego quashed the results in Wajir, Mandera and Garissa and ordered the Kenya National Bureau of Statistics (KNBS) to repeat the exercise in the three counties
“Take Notice that Lempaa Suyianka and Kenneth Njagi and a non-governmental organization African Institute for Peace and Human Rights based in Kenya being dissatisfied with the Judgement of the Justice Joseph Onyiego, given at High Court Garissa on 28th January, 2024 intends to Appeal to the Court of Appeal against whole of the said Judgement,” the lobbies said ina notice.
Through lawyer Kibe Mungai, the lobbies applied to be given certified copies of the judgement.
Justice Onyiego quashed the 2019 Census results stating that KNBS failed to uphold fundamental data integrity standards, leading to inaccurate population figures.
“The published results in Volume 1 of the 2019 Kenya Population and Housing Census (KPHC) in respect to the mentioned areas are hereby cancelled,” he stated.
The affected sub-counties include Mandera North, Mandera West, Banisa, Lafey, Mandera East, Mandera South, Eldas, Tarbaj, Wajir West, Wajir East, Wajir North, Balambala, Lagdera, Dadaab, and Garissa Township.
