COURT HEARS HOW BOARD COUNTERMANDED RUTO ON APPOINTMENT OF EAPCC MD.

A judge has expressed shock that the board of East Africa Portland Cement Company (EAPCC) annulled President William Ruto’s appointment of Bruno Oguda Obodha as the managing director of troubled cement maker.

While appearing before Justice Byram Ongaya, the parties informed the judge that Mohammed Adan was appointed the new boss by the board, in a decision that was endorsed by Cabinet Secretary Trade and Investments.

In a letter tabled in court, the Board of directors lead by chairman Richard Mbithi appointed Adan as the company the company managing director in February, after several cases challenging the appointment of Obodha were withdrawn.

“Further to the interview that you attended on 22nd November, 2024, the Board of Directors (hereinafter referred to as “the Board”) of East African Portland Cement PLC (hereafter referred to as “the Company”) hereby appoints you as the Managing Director based on the Board resolution passed on 22nd November, 2024 on the terms and conditions set out,” state Adan appointed letter.

The board of directors advertised for the position but in a press release on December 20, Mr Obodha was announced at the new MD “based on recommendations of the Public Service Commission.”

His appointment was, however, challenged in court.
