Constitutional activist Okiya Omtatah who challenged President Uhuru Kenyatta’s appointee to the Betting Control and Licensing Board.

High court has temporarily suspended President Uhuru Kenyatta’s appointee to the Betting Control and Licensing Board.

High court Judge Nduma Nderi stopped the implementation of a Gazette Notice issued on June 23 where Dr Francis Kipkurui Sang was appointed to the board.

It also revoked the subsequent sacking of Mr Anthony Kimani Kungu.

The order is following a suit filed by activist Okiya Omtatah who argues that Kipkirui’s appointment was irregular and unconstitutional under the State Corporations Act (Cap 446).

In the suit papers, Omtatah argues that the president while appointing Kikirui as Chairman of the Board, he simultaneous removed Anthony Kimani Kungu as the chairman which was outside the scope of the law.

Omtata argues that Kungu was never removed from being the Chairperson of the Board and remains validly in office for the remainder of his three year term.

He appointed 23 people to serve as Chairperson’s of various Management Boards among them Dr Kipkurui.

Justice Nderi directed parties to file and exchange responses and submissions for the hearing of the petition on October 3.
