The court has given blogger Cyprian Nyakundi one week only to personally appear in court so he can receive “appropriate punishment” for defaming Safaricom CEO Bob Collymore.

Nyakundi skipped court for the second time yesterday. He has however been given a last chance to attend on February 8.

Justice Mwihaki Njuguna allowed him time to file a reply to allegations that he has continued to write and share offending articles maligning Collymore.

Lawyer Nani Mungai, representing the Safaricom CEO, said there was no plausible explanation of Nyakundi’s absence in court while he is still actively engaged on social media.

He applied for a warrant of arrest against Nyakundi but the Judge observed that he deserved the final adjournment to present his mitigation before sentence is pronounced.

Mr Mungai has accused the blogger of not showing remorse despite being found guilty of deliberately disobeying court orders restraining him from publishing offending articles on social media from last year December.

Safaricom boss wants Nyakundi to be jailed to block him from publishing any other defamatory articles that touch on his person.

A political aspirant for the Kibwezi West Constituency has been arraigned in Milimani law courts with charges of fradulently trying to sell a parcel of land.

James Kimathi Mbaluka pleaded not guilty  to the charges of obtaining Sh10 Million from Rachael Kaki Nyamai by pretending he was in position to sell a parcel of land  in Karen within Nairobi City County.

The Wiper Party parliamentary hopeful was released on a cash bail of 80,000 and a bond of 2million over a parcel of land he is accused of trying to sell. The land registered as LR Number 12302/8 is said not to be in his procession by the time he was selling it.

Mr Mbaluka through his lawyer pleaded with the Chief Magistrate Francis  Andayi to defer the plea.  “This matter is related to a commercial dispute before the high Court and there’s a ruling on how my client should pay the amount. My client has already paid 2million and is willing to settle the entire amount as per the ruling ” submitted the lawyer.
Despite the advocate saying there could be malice in the way his client was being charged in a criminal case, the magistrate dismissed the application. The court was told through the prosecution that  there was no order from the superior  court staying the proceedings from magistrate court.
“There’s no compelling reasons adduced by the defense to enable this court to differ the plea and I direct the accused person to take the plea” magistrate ruled.

A Proposal to have the National Youth Service case start afresh has flopped.

The court decided that it will continue with the hearing from where trial magistrate Daniel Ogembo left.

In the case former Devolution Ps Peter Mangiti and Former NYS boss Nelson Githinji Nelson Githinji wanted the case to be heard afresh.

Trial Magistrate Daniel Ogembo was promoted to a High Court judge.

The case will now be heard by Nairobi Chief magistrate Francis Andayi on the 15-19 May this year.

The pain inflicted on former Kenya Air Force Commander Major General Peter Kariuki by ex-President Daniel Moi’s government over the failed 1982 coup attempt has made him demand over quarter a billion shillings.

According to Kariuki, he was imprisoned and tortured ruthlessly by colleague officers.

A judgment was entered into his favour and the compensation has now come to almost Sh287 million.

“There is no other civil or lawful means by which the applicant can obtain the sum of money and restoration of rank, benefits, decorations and honors but through the court,” he says.

In 2014 the court of appeal awarded him Sh37 million after it ruled that General Kariuki’s constitutional rights were violated by a court martial which tried him and sentenced him to four years imprisonment for failing to prevent and suppress the mutiny.

The Sh37 million has accrued interest to over Sh287 million.

CLINICIANS THREATEN TO GO ON STRIKE FOR BETTER PAY.

Clinical officers have threatened to go on strike if the government fails to address their grievances.

They also want to register their own union that will look into their plight.

The move is seen to reflect the doctors union which has been championing for higher pay since December last year.

They want the Employment and Labour Relations court to compel the Registrar of Trade Unions to allow them register their own union.

Kenya Union of Clinical Officers chairman Peterson Wachira says that the clinical officers have been deprived of the right of association by being barred from registering their Union of Kenya Clinical Officers (UKCO).

The members of the proposed Kenya union of clinical officers are working under very challenging conditions including working for 24 hours a day every week because the officers do not have a mechanism for bargaining collectively for suitable terms and conditions of service.

“It is in the interests of justice that the human suffering be ended as soon as possible,” argue the clinical officers.

They claim they are fatigue by overworking.

Justice Nduma Nderi directed that the matter be heard on the February 13.

Inspector General of Police Joseph Boinett and his counterpart from the Directorate of Criminal investigations Ndegwa Muhoro have less than 24 hours to appear before court.  
 
The two senior most officers have been summoned by a Mombasa court to explain the whereabouts of Akasha’s children and others arrested over drug trafficking allegations.
 
Justice Njoki Mwangi has ordered the two to produce Batash Akasha Abdalla, Vijaygiri Goswami, Ghulam Hussein, Ibrahim Akasha Abdalla dead or alive together with the original if any arrest or order of detentions.
 
The suit has been fixed for hearing before Lady Justice Dorah Chepkwony tomorrow.
 
This is following accusations by criminal lawyers Cliff Ombeta and Wandugi Kiraithe who vowed that the police must produce their clients in court.
 
They were arrested by highly trained officers from the Special Crime Prevention Unit and the Anti-narcotics unit in connection to an undisclosed offence.
 
The wife to Batash Akasha Abdalla in the suit said she has looked for her kindred in Nyali and Mombasa police stations but her frantic search has bore no fruit.
 
Akasha’s wife Najma Akasha further informed her lawyers that her husband was arrested by the said officers after midnight on the 29 of this month and also taken to undisclosed location.
 
The US wants the son and three others extradited to face drug trafficking charges.

UN REINSTATES SOUTH SUDAN’S COMMANDER-SHIP TO KENYA.

The United Nations has extended an olive branch to the Kenyan government in a row that saw President Kenyatta order the withdrawal of Kenyan troops from war-torn South Sudan.

UN agreed to repair its checkered relations in a bilateral meeting between President Uhuru Kenyatta and new UN Secretary-General Antonio Guterres at Addis Ababa, Ethiopia.

Kenya played a key role in South Sudan peace process which was recognized as a milestone in ensuring there is harmony within the East Africa community.

“I want the United Nations to be reconciled with Kenya. Let us make a fresh start. Kenya is a very important player in the region,” Guterres told President Kenyatta.

Kenya withdrew its troops from the UN mission in South Sudan in November 2016 after its mission commander was relegated without consulting the mission.

“I feel that we have to work together to secure peace and security. Let us put the past behind us,” the UN chief said.

He added that the United Nations has full confidence in Kenya’s Military.

“As a sign of our confidence in the Kenya Defence Forces, and in the Kenyan government, the UN would like to offer Kenya the Darfur command,” Guterres added.

President Kenyatta said he is looking forward to senior officials from both sides meeting in Addis Ababa to work out details of the new engagement.

UON DON CHARGED FOR DEMANDING SH5000 KICKBACK FROM STUDENT.

University of Nairobi lecturer has been charged for demanding a bribe from a student to award him marks.

Dr Vincent Mbindo Kathimo of the Faculty of Agriculture is accused that on January 18 at upper Kabete campus of UON demanded for a financial advantage of Sh5, 000 from Duncan Kibet as inducement so as to award him exam marks after he was found cheating on an exam during last semester.

He also accused that on the same day at Uthiru being a person employed by public service as a lecturer received a financial advantage of Sh3, 000 from Duncan Kibet as an inducement so as to award him the exam marks.

Mbindo is also accused of demanding the balance of Sh2, 000.

He was released on a Sh80, 000 cash bail with a bond of Sh100, 000.

The matter will be mentioned on 17, of February for further directions.

SOUTH SUDAN REBEL LEADERS WILL NOT BE DEPORTED, COURT SAYS.

The High Court has stopped the deportation of two rebel leaders loyal to South Sudan’s former Vice President Riek Machar.

Justice Luka Kimaru further directed that mobile providers provide communication data to determine the whereabouts of other leaders Dong Samuel Luak and Aggrey Idri Izbon

According to the petition filed in court, former deputy chairperson of the SPLM-IO committee for constitutional affairs Dong Samuel Luak and chairperson of the SPLM-IO committee for humanitarian affairs Aggrey Idri Izbon have been missing since Monday this week.

The petitioners argue that the Kenyan authorities have denied knowledge of the disappearance of the two opposition officials in Nairobi.

The court heard that the applicants were unlawfully detained on 23rd contrary to article 47 of the constitution of Kenya adding that the family of the two missing people reported with the police on the same day but no response has been forthcoming.

They further argued that there is a high likelihood that if the court does not intervene, the two will be deported back to their war torn country with serious ramifications as to their safety.

“I am reliably informed that the deportation is underway, my sources are reliable and confidential,” argues Eddy Orinda.

Proceedings resume Tuesday next week.

KIAMBU GOVERNOR CLEARED OF HATE SPEECH.

Kiambu Governor William Kabogo is free, his talk was not based on hateful remarks, court decides.

It is alleged that the governor in his statements was targeting a certain community in the country.

Trial Magistrate Martha Mutuku dropped the charges of hate-speech and ethnic contempt against the governor for lack of sufficient evidence.

The court said that the prosecution had not established that Governor Kabogo uttered words that are likely to cause violence.

She faulted the prosecution for solely relying on video clips by media houses which recorded the politician saying they might have been edited for consumption by the general public.

Magistrate Mutuku also criticized the state for failing to call the camera person who recorded the incident to testify and confirm to the courts whether the Governor made the alleged remarks.

It was also her view that two witnesses who were called upon to give evidence including musician John de Matthew were not sure whether the Governor uttered the said remarks.

Governor Kabogo was accused that on November 25 last year, he uttered words which were intended to invite feelings of contempt against  persons and community in Kenya that do not ethnically embrace male circumcision.
