JSC ASK LOWER COURT TO SURRENDER CASE FACING JUDGE FROM APEX COURT.

Judicial Service Commission (JSC) has asked the high court to surrender a disciplinary case it is handling concerning a judge of the Supreme Court.

The judicial commission also wants the lower court to consent to Supreme Court Judge Njoki Ndungu facing a special committee appointed by JSC to investigate her alleged misconduct.

In a response to Judge Ndungu’s petition contesting the mandate of the committee formed to investigate her, Chief Registrar Ann Amadi affirmed the panel composition saying it is competent and will determine whether an allegation of judicial misconduct is merited or unmerited.

CRJ also held that the constitutional responsibility for determining the merits of any claim of judicial misconduct of a judge lies with the JSC and not with the court.

“The petitioner is wrong in attempting to shift the locus for determination of the merits of the particular misconduct claims, since the constitution provides that merits of any claim be determined by a tribunal to be appointed by the President with right of appeal to the Supreme Court,” she states.

Ms Amadi says that JSC intends to give the judge an opportunity to be heard in the event that alleged claims may give rise to a recommendation for the appointment of a tribunal to investigate claims of misconduct.

“The court should decline to consider substantive matters touching on the confidential minutes since this would require the court to invite the various judges of the Supreme Court to give evidence before the High Court and be cross-examined on judicial deliberations,” she states.

Justice Ndungu is aggrieved following the decision to probe her conduct over the manner in which she handled an election petition filed by Kanu Secretary General Nick Salat in which she deliberated on the retirement age of judges.

The committee was set up on February 29, 2016 following a complaint by former LSK Chief Executive Officer Lawyer Apollo Mboya.

Hearing resumes on July 11 before Judge Joseph Onguto.

The two American power house remained goalless after extra time which necessitated for post match penalties.

In the shootout both teams missed in their first attempt penalties.

Messi goes into history to have missed the first chance in the Copa 2016 final for Argentina.

Chile then netted their remaining four shots while Argentina had to settle with just two and lose the final for the second consecutive time.

Chile won 4-2.

Star Lionel Messi has never won any major tournaments with Argentina.

A campaign to return Britain to the EU block has gained momentum exceeding the targeted signatures by over three million.

This is after a Thursday’s referendum that saw a 72% turnout of 17.4 million people, with 52% voting to leave the EU against 48% voting to remain.

The petition calls for the government to annul the vote if the remain or leave vote was less than 60% from a turnout of less than 75%.

In Britain the when petitions reach over 100,000 signatures, the government must subject it to debate in parliament.

Meanwhile, senior Labour MPs have also called for action to prevent a Brexit from the EU.

Tottenham MP David Lammy said: “Wake up. We do not have to do this. We can stop this madness and bring this nightmare to an end through a vote in parliament. Our sovereign parliament needs to now vote on whether we should exit the EU.

“The referendum was an advisory, non-binding referendum. Parliament now needs to decide whether we should go forward with Brexit and there should be a vote in parliament next week.”

Football is hard hit by the exit of Britain from the European Union.

Signing foreign players under the age of 18 will now be harder than ever.

The ramifications are likely to stretch across political and economic spheres but British football, too, is facing uncertain times as the country looks to stabilise amid the expected turmoil in the wake of the result.

Experts say that the impact of the Brexit on the sports world could be significant.

“However, we will not know how significant this will be until we have a clearer idea of the terms the UK negotiates for its continued relationship with the EU. If the agreement with the EU includes broad free movement obligations, such as those currently in place with European Economic Area members, the current position regarding the movement of players between the continent and the UK will most likely continue.

“If, instead, an agreement is reached which includes restrictions on the movement of persons and services, the impact on the sports world would be more significant.

“Firstly, English players may not be able to move to the continent freely and EU nationals could be subject to entry restrictions when seeking to play in England, if post-Brexit they are treated in the same way as current non-EU nationals.”

Experts say that it could be problematic for Premier League sides to sign young players from abroad.

They say that if the EU law ceases to apply in the UK, the organisers of sports competitions may be able to more effectively restrict the number of foreign players that feature in match day squads as they could potentially include EU nationals and Kolpak players within any foreign player quota.

Deputy President William Ruto has launched a campaign to win over Cord co-principal Moses Wetangula.

DP Ruto said Senator Wetangula ought to leave the opposition and join the Jubilee government ahead of the 2017 general elections.

The Deputy President was attending the burial of Webuye West MP Dan Wanyama’s mother on Saturday.

“Some time back I was in the opposition and Senator Wetangula was in the government but it seems roles were switched and I am now in the government and he is in the Opposition where there are so many doubts of the candidate, party to vie in and such,” he stated.

“Whatever he is trying I did several years ago and it is for the good of the people that he makes up his mind,” the DP added.

Senator Wetangula faces a major battle between his co-principals Raila Odinga and Kalonzo Musyoka who also want to win Cord’s presidential ticket.

A showdown looms in Imperial Bank after a customer moved to court contesting a decision temporarily stopping the transfer of assets and payment of money to those who deposited with the bank.

MS Josephine Awino Kogweno, a lawyer said that it was disappointing that the shareholders would block the one chance and or channel that myself and other depositors are assured of receiving our money.

She said that she had looked at the proposals filed in court by the imperial directors which she says make no mention of payments to depositors, “while they proceed to block any chance of the depositors being paid.”

“I have noticed from the replying affidavit by Kenya Deposit Insurance Corporation,” she said “that the shareholders intend to further defraud the public, by proposing to raise Sh5 Billion by way of a rights issue particularly taking into account that just before the bank was placed into receivership it had under sanction of the applicants under the management of its directors floated a bond for Sh2 billion.”

Ms Kogweno also said that the decision to appoint NIC bank to act as the Asset and Liabilities Consultant for Imperial Bank Limited in which capacity it will undertake on behalf of KDIC an assessment of the quality of IBL’s assets and liabilities, support the recovery of IBL’s loans, and provide guidance on other assets and on staffing was most likely informed by the fact that NIC Bank’s niche in the banking industry is with regards to asset financing and management, and are therefore highly competent and experienced in this regard.

At the time the bank was placed under receivership, Ms Kogweno had deposited at Imperial Bank Limited a sum of approximately Sh32 million being funds from various clients.

She said that during this period she has had difficulty running her Law Firm, and having to explain the plight of client money deposited with the bank.

The decision by Central Bank of Kenya to sell off the assets of Imperial Bank was overturned yesterday after disgruntled directors challenged the move.

The regulator had on Tuesday announced that it had entered an agreement with Kenya Deposits Insurance Corporation and NIC Bank to effect the payment of Sh1.5 million to depositors.

“Subject to a due deligence and contract review and negotiations, KDIC will dispose of and NIC will assume a portion of the remaining cerified deposits with certain assets and liabilities,” Central bank announced.

The bank directors unhappy will the move told the court that the action by the regulator ultimately culminates to the liquidation of the bank.

Lawyer Wadabwa for the directors said that unless the court intervenes that unreasonable decision will be at grave detriment and loss of his clients’ depositors, bondholders and employees.

A decision by citizens of the United Kingdom to leave the European Union (EU) dubbed ‘Brexit’ represents a colossal but significant twist to the European history.

Britain voted affirmatively to leave the EU which occasioned the resignation of its Prime Minister David Cameron.

It is moments after the vote that its currency, the pound slumped and lost hugely in the money market.

The exit could take anywhere from two to 10 years to fully disengage from the EU.

Right now, membership in the EU or its looser cousin the European Economic Area (EEA), commits a country to four “pillars,” one of which is the free movement of labour. This means that any citizen of an EU or EEA country can move to another and seek employment. It abolishes all discrimination against foreigners provided they are from either the EU or EEA.

The vast majority of the pro-Brexit camp wants Britain to continue tariff-free trading with the EU on favored terms. That would mean either being part of the EEA (in which case they would still have to guarantee freedom of movement) or negotiating a deal whereby Britain could still impose strict immigration controls while enjoying free trade.

UK will have to sign bi-lateral deals with every country and that would be very difficult and take a long time.

This pave way for a political showdown in his conservative party.

He was re-elected as British prime minister barely a year ago.

Cameron has held power for six years touted to have improved the working conditions of his people.

Politicians eyeing to replace him will experience tough times renegotiating Britain’s place in the European market.
I want to thank everyone who took part in the campaign on my side of the argument, including all those who put aside party differences to speak in what they believe was the national interest and let me congratulate all those who took part in the Leave campaign for the spirited and passionate case that they made.

The will of the British people is an instruction that must be delivered.

It was not a decision that was taken lightly, not least because so many things were said by so many different organisations about the significance of this decision.

So there can be no doubt about the result.

Across the world people have been watching the choice that Britain has made.

I would reassure those markets and investors that Britain’s economy is fundamentally strong and I would also reassure Britons living in European countries and European citizens living here there will be no immediate changes in your circumstances.

There will be no initial change in the way our people can travel, in the way our goods can move or the way our services can be sold.

We must now prepare for a negotiation with the European Union.

This will need to involve the full engagement of the Scottish, Welsh and Northern Ireland governments to ensure that the interests of all parts of our United Kingdom are protected and advanced.

But above all this will require strong, determined and committed leadership.

I’m very proud and very honoured to have been Prime Minister of this country for six years.

I believe we’ve made great steps, with more people in work than ever before in our history, with reforms to welfare and education, increasing people’s life chances, building a bigger and stronger society, keeping our promises to the poorest people in the world and enabling those who love each other to get married whatever their sexuality, but above all restoring Britain’s economic strength.

And I’m grateful to everyone who’s helped to make that happen.

I have also always believed that we have to confront big decisions, not duck them.

That is why we delivered the first coalition government in 70 years, to bring our economy back from the brink.

KENYA EYES ETHIOPIA IN OIL DEAL.

The exit of Uganda and Rwanda from an oil pipeline deal with Kenya is not lost yet.

Kenya has now turned its attention to the north eyeing Ethiopia for development of the pipeline.

The two countries signed a deal for an oil pipeline that will run from Lamu to Addis Ababa under the Lapsset project.

President Uhuru Kenyatta and Ethiopian Prime Minister Hailemariam Desalegn signed the pact during bilateral talks at State House, Nairobi, on Thursday.

During a joint press briefing, President Kenyatta said Kenya is working closely with Ethiopia on the Lapsset project.

Kenya and Ethiopia also agreed to strengthen their strategic alliance.

“We are both committed to actualising the provisions of the sustainable peace agreement we signed last year, which will reduce the vulnerabilities faced by border communities,” President Kenyatta said.

The two countries have also been working together to stabilise and bring peace to Somalia and the region.
Prime minister Hailemariam said Ethiopia considers Kenya a strategic partner and a natural friend given the similarities between the two countries.

He said Kenya and Ethiopia are key to the stability of the region and Africa.

“Kenya and Ethiopia are the pillars of the region and we have to work together to stabilise the region,” he said.

Witnessing the pact were Deputy President William Ruto and Ethiopia ministers.

The pact is on oil, gas, health, sports, cross border cooperation in animal health and sanitary measures, and education.

State House will tonight host a state banquet in honour of the visiting Prime Minister.

POLICE FORCE TO REDEEM TAINTED IMAGE.

Police have launched a program aimed at redeeming their tainted image.

Proposal for reforming the National Police Service have been adopted and will be implemented so as to equip police officers with knowledge on specialized areas including anti-corruption, code of conduct, gender and human rights and accountability.

Interior CS Joseph Nkaiserry also said that the reforms will re-evaluate the 2011 police training curriculum, and forge partnerships that will unify Police in Kenya.

The reforms will in addition consolidate commands and controls so as enable police weed out enemies that exploits cracks in the security sector.

CS Nkaiserry also said that the reforms are a guide in achieving police discipline and integrity.

These reforms, he said will be undertaken in collaboration with NPS, Sweden, United Kingdom, United States and European Union to enhance security in the country.

“The objective of the partnership reform is to increase capacities for internal and external accountability, transparency and prevention of corruption,” said Nkaissery.

He further commended an improvement the ratio of police to civilians which is currently at 1:430.
