Embattled Korogocho MCA Absalom Odhiambo has been charged with incitement to violence.

Odhiambo appeared before Milimani before Milimani chief magistrate Lukas Onyina and denied the charges, a few days after he was set free unconditionally.

The lawmaker is accused of uttered inciting words which implied to cause anarchy in the country. He allegedly committed the offence on January 25 at Jaramogi Oginga Odinga foundation in Capitol Hill.

According to charge sheet produced in court, the MCA said, “Kwa siasa ya Taifa tunataka tutoke kwenda ikulu tutoe huyu mwizi, nataka tuingie town tufunge biashara, hakuna biashara itaendelea hii town ya Nairobi, ndio William Ruto aheshimu Raila Odinga. Lazima tufunge biashara hii town”.

Prosecution accused Odhiambo of using threatening abusive words with intent to provoke peace on the same day and place.

State prosecutor Anderson Gikunda did not oppose his release on bond but asked the court to gag the accused from addressing any public forum.

Gikunda told the court that Odhiambo being a politician should not interfere with witnesses and further should not make comments in the media about the trial of this matter.

Odhiambo’s lawyer Danstan Omari asked court to release him on lenient bail terms saying he is a public officer.

The lawyer said if found guilty of breaching peace by using abusive language, the accused person will be fined Sh5000.

He added that Odhiambo was not a flight risk and urged the court not to gag him from addressing the public, being part of his job as a politician.

He was released on a cash bail of Sh100,000 as the court cautioned him against interfering with witnesses.
