A director of a civil engineering firm has been charged with stealing and intermeddling with the estate of a deceased person.

Tom Njoroge Waiharo, who is also a Catholic missionary further faces charges of forgery and stealing.

He appeared before Milimani Chief Magistrate Lucas Onyina where he pleaded not guilty to the charges.

The charge sheet said Waiharo committed the offences on diverse dates between April 2021 and 29th October 2025, at ASK Grounds, Jamhuri Park, Nairobi County.

The first count stated that he unilaterally transferred the assets of Mass Labs Limited to Apex Projects Limited thus transferring the stake of Joseph Santet Ole Shoona (Deceased).

It was further alleged that he made the transfer without the consent of the administrators of the estate, Lawrence Lein Shoona, Caroline Lipaso Shoona and Lois Shena Shoona.

He was further accused of stealing the assets and property of Mass Labs ltd valued at approximately Sh25 million, which came into his possession by virtue of his position as a director of Mass Labs ltd.

The court heard that on December 6, 2023 with intent to defraud, Waiharo forged minutes of Mass Labs ltd purporting them to be genuine and valid minutes signed by Lawrence Lein Shoona.

He was also accused of making the minutes and purporting the same to be genuine and valid minutes.

He was released on a bond of Sh500,000.
