A Nairobi court has allowed the police to detain a man wanted in the USA for murder, pending extradition proceedings.
Milimani Chief Magistrate Lucas Onyina allowed application by Directorate of Criminal Investigations to detain Hudeife Muhumed Mire for 31 days.
The DCI told the court that Mire was arrested on October 29, 2025 in Ongata Rongai, Kajiado County.
The suspect was booked at Gigiri police station, pending further directions.
The DCI said Mire is being investigated for the offence of third-degree murder in violation of Minnesota Statute.
He is also being probed for distribution of controlled substance in violation of Minnesota Statute.
The court further heard that the suspect was likely to face a charge of manslaughter in the second degree.
Mire is alleged to have murdered Samantha Myers on April 16, 2022, by selling drugs laced with deadly fentanyl whose overdose killed the victim.
“From the time Mire was arrested, the time to conclude investigations and subsequent extradition to the United State has not been adequate and the applicant requires 30 days to enable completion of Extradition process while Mire is in custody,” court heard.
The police said Mire fled the State of Minnesota and travelled to Nairobi, Kenya, with intent to evade prosecution, thereby constituting an extraditable offence under Kenyan law.
The court heard that under the Extradition (Contiguous and Foreign Countries) Act. Cap. 76. Section 4, read together with the Mutual Legal Assistance Act, No. 36 of 2011, Kenya is empowered to cooperate with foreign states in criminal matters, including arrest and detention of fugitives pending extradition or deportation.
“The offences for which the respondent is wanted are punishable under the laws of the requesting state and would constitute offences under Kenyan law if committed within Kenya, thus satisfying the dual criminality requirement under Section 4 of Cap. 76,” court heard.
Kenya, the DCI said is a member of Interpol and bound by its Constitution and Rules. which obligate member states to assist in locating and detaining fugitives upon issuance of a valid Red Notice or request from a competent authority.
The Interpol National Central Bureau (NCB) Nairobi received a formal request from.itw counterpart in Washington and the US Department of Justice for the provisional arrest and detention of the suspect, pending extradition proceedings.
The police said pursuant to Article 2(6) of the Constitution of Kenya, international treaties and conventions ratified by Kenya form part of the law, and Kenya is bound by the United Nations Convention Against Transnational Organized Crime and the International Convention on mutual assistance in criminal matters.
