CRIMINAL CASE AGAINST TRADER WITHDRAWN.

Prosecution has withdrawn a delayed case against a city businessman.

 

Trial Court Deputy Registrar Faith Muguongo the withdrawal of the case against Rogers Okuta Ochieng after the court heard that the complainant has lost interests in the matter and has never appeared before court since 2017.

Prosecution accused Ochieng of obtaining Sh 1,339,823 and Sh 1,462,500 from one Ivy Nyawira Mwai to import for her a motor vehicle (Volswagen Tiguan) from Kobo Motors Company in Japan, a fact he knew to be false.

He is alleged to have committed the offense on diverse dates between 30th January and 16th March 2016 at CFC Stanbic Bank in Westlands, Nairobi County.

The businessman was arrested and presented before court on 26th January 2017 where he pleaded not guilty to the charges.

According to Ochieng’ the car, which is now in the possession of the complainant had already been imported and was awaiting clearance at the port. He was out on a cash bail of Sh 200,000.
