Isiolo County Secretary Ibrahim Wako has moved to court seeking orders to stop the Ethics and Anti-Corruption Commission (EACC) and the Director of Public Prosecution (DPP) Keriako Tobiko from prosecuting him.
The two institutions want to prosecute Wako for allegedly signing a contract that had been awarded by Tender Committee before expiry of fourteen days minimum period.
DPP Keriako Tobiko has recommended charges against Wako.
The intended prosecution is premised in the award of a tender through restricted tendering by the County Government of Isiolo.
Through his lawyer Muathe Issa, Wako claims that he is not a member of County Tender Committee and it is not fair to charge him.
“The intended criminal charges are patently unlawful and it is based on inter clan dispute through the instruments of state,” said Issa in court documents.
Wako claims that on January 13, 2016, it was reported in the newspapers and on social media that Tobiko has recommended his prosecution by way of press statement.
“The release was followed a report from EACC dated December3, 2015 recommending Wako’s prosecution,”said Issa.
He added that the allegations are that he failed to comply with the law in relation to procurement.
The report stated that executed a contract agreement for Sh 31 million awarded to shamsalab Construction Limited before the statutory period of fourteen days has lapsed after the issuance of notification of the award as stipulated by law.
Wako claims that he did not participate in any procurement proceedings. He added that the prosecution is being used in bad faith to oppress the and therefore wants the court to stop the prosecution.Wako is seeking orders that will prohibit Tobiko from commencing proceedings to charge him.
He is seeking courts intervention to quash the decision of EACC and DPP recommending his charging and prosecution. The matter will be heard today.
