Kenya Breweries limited has lost an attempt to stop distributer Bia Tosha from supplying their products across the country.

 Justice Joseph Onguto also declined an appeal to direct the dispute to an arbiter saying that the court had jurisdiction to hear and determine the petition filed by Bia Tosha.

In declining to vary the order, the court said it could amount to rendering the petition useless.

“Its important to preserve areas covered by  Bia Tosha, pending the hearing and determination of the petition” the judge said

Justice Onguto said that the order he issued on 14 June 2016 in favour of  Bia Tosha distributors limited shall remain in force until the matter is heard and determined.

The judge heard that  the order issued meant that Bia Tosha distributors  have exclusive right to supply beer in areas named as, Namanga , Kajiado Kitengela, Athi River Industrial area, South B  Nairobi West, Dagoret and other designated  town within  Nairobi  County allegedly being supp;lied EABL by  Bia Tosha  distributors.
