NACADA boss John Mututho

NACADA boss John Mututho is safe for now after the High Court reinstated him as the anti-narcotics chief.

The desire to send him home had been reached by Interior Cabinet Secretary Major Gen. (Rtd.) Joseph Nkaissery.

High Court Judge George Odunga ruled that Mututho has presented an arguable case before the court and as such should be heard before being condemned.

Mr Mututho in his application claims that in a letter dated September 6, 2016 CS Nkaiserry purported to retire him on grounds that he has been appointed Chairman of the Transport Licensing Appeals Tribunal.

He says that the purported retirement is malicious adding that even Kenyans know he he has been leading in  fighting corruption at the Authority thereby killing drug cartels.

He Further states that CS Nkaiserry failed to comply with the law  and has not been given a procedurally fair administrative action.

Mututho believes the decision to retire is a witch-hunt which is a consequence of his corruption claim against officers attached to the Authority to the Ethics and Anti-Corruption Commission (EACC).

Those officers are currently facing charges in court where he is one of the key witnesses.

Proceedings resume October 4.
