DPP WANTS JUDGE OUT OF TERROR CASE.

Director of Public Prosecution now wants High Court Judge Ngenye Macharia to recuse herself from hearing an appeal in which suspected Islamic State (IS) terror group leader, Mohamed Abdi Ali alias Abu Fidaa is seeking to be granted bail.

DPP through senior prosecution counsel Duncan Ondimu claims Justice Ngenye Macharia did not treat them fairly in a similar matter in which it was seeking bond cancellation of Ali’s Wife Nuseiba Mohammed Haji who was charged with terror related charges.

Ondimu claims that the prosecution is apprehensive that the Judge will not give a fair hearing to the application and thus she should recuse herself from the matter.

In the appeal, Ali is seeking to be released on bail pending his trial at the lower court.

Ali was charged with eight counts of terror related charges.

ATPU in Court documents is opposed to his release on bail claiming that the accused person is extremely dangerous and poses serious danger to the national security and public safety of the country and the entire world and thus should not be released on bail pending his trial.

ATPU claims that Phone chat  recovered  indicates connection to  recruitment cells  in Libya, a need to make fake  currency  and plans to sells  drugs to raise money  for Jihad.

Further, Computer and Cellular Examinations Forensic Report reveals that the accused person and his associates some who are already before the court adopted the use of chat applications that are rarely used like KIK and THREEMA for text based chat.

“Computer  and Cellular Examinations  Forensic Report also reveals a chat account  THREEMA  user known as Simba  and user  Abu  Fidaa discussing  the possibilities of getting toys, explosives , grenades  and rifles  for a possible attack,” said  Investigating Officer  Bwire  in court documents.

The Anti-terrorism body alleges that, in an interview with the accused person during the investigations, he confessed to having been in communication with Simba who is allegedly based in South Africa.

“Their communication was planning to conduct an attack in South Africa  due to the xenophobic attack  that was carried  out against  Muslims more so  Somalis residing there  and also because South African Government  is involved in fighting ISIS  in Nigeria,” added the Officer.
