Four Eastleigh businessmen have been charge afresh with breaking into a building and stealing dollars and gold.

Billow Abdi Abdile, Mohamed Kanyare Billow, Kahinya Mohamed Omar and Peter Gitau Ndungu appeared before magistrate Martha Mutuku and denied the charges.

They were charged afresh after two of the accused Hassan Adan Noor and Gachin Dugow were acquitted of all the charges due to lack of enough evidence to hold them.

The court heard that on August 25 and 26, 2015 at united textile mall along First Avenue, jointly broke and entered shop number b-9 of Hassai Mohamed Tifon and stole 2,558,000 US dollars 85 c and 22.6 grams of gold at Sh 90,400 the property of the said Hassan.

They faced twenty two more counts of breaking into different shops and stealing properties within that area.

The defense said they were ready to proceed with the case but the witnesses were not in court.

The prosecution requested the court to issue summons against two of the witnesses who did not appear in court to give their testimony.

Through lawyer Cliff Ombeta, the defense said that the prosecution is delaying the proceedings and if the witnesses are not available the matter should be terminated.

The prosecution said that this is a 2015 matter and the witnesses had appeared in court last year’s severally but the matter failed to proceed.

“The witnesses appeared in court the whole of last year but the matter was adjourned until they got tired,” said the prosecution.

The magistrate ordered the matter to be heard on January 7.They are out on Sh 500,000 cash bail.
