NASA has demanded that Safaricom and Jubilee’s chief agent Davis Chirchir be barred from participating in the presidential election slated October 26.

In a letter addressed to the Director of Public Prosecution Keriako Tobiko NASA says that Safaricom Limited and Chirchir grossly committed electoral offences.

The coalition has however not adduced any evidence to support their claim.

They have however requested the DPP to conduct investigations against the two and charge them.

In the letter, NASA says that Safaricom and Chirchir must be punished for allegedly influencing the results of the Presidential election that was cancelled by the Supreme Court of Kenya.

“Our express instructions are that Davis Chirchir and Safaricom Limited not only committed criminal acts of which they should be held personally responsible , but also aided and abetted the commissions of offences under the Elections Offences Act , public procurement Act , Elections Act, Penal code and breaches of the constitution,” the letter reads.

NASA lawyer Anthony Oluoch says that unless investigations and prosecution is commenced within 72 hours by the DPP, the party will institute private prosecutions pursuant to section 28 of the Office of the Director of Public Prosecution.

The opposition has already drafted charges against Safaricom officials who include Thibaud Rerolle, Anthony Gacanja, Shaka Kwach , Robert Mutai, Farouk Gaffor and Andrew Masila .

NASA claims that between July 25 and August 11 at Safaricom Headquarters within Nairobi County with other persons they intentionally and recklessly damaged and interfered with KIEMS kits used in the general elections conducted on August 8.
