Activist Okiya Omtata is pushing for the removal of nominated Senator Beth Mugo and Eldas Member of Parliament Adan Keynan from the Parliamentary Service Commission.

The rights crusader says that the two have served in parliament beyond the one term allowed in law.

“The approval of the two to serve beyond the limit of five years is expressly unconstitutional and, therefore, invalid, null and void abinitio.” Mr Omtatah argues.

Rarienda MP Otiende Amollo had also raised issue with the nomination of the two urging the speaker of the National Assembly Justin Muturi to give direction on the issue.

Mr Omtata cautioned that no provision of the constitution expressly allows MPs who are also commissioners of the PSC to serve for more than one term of five (5) years.

He added that parliament has threatened and violated specific provisions of the constitution and the law, thereby undermining constitutionalism in general and the rule of law in particular.

He now wants the court to suspend MP Keynan and Senator Mugo’s appointment on Thursday 22nd February 2018 as members the Parliamentary Service Commission.
