COURT STOPS KNCCI FROM REPLACING CEO.

Employment and Labour Relations court has stopped Kenya National Chambers of Commerce and Industry from replacing the current Chief Executive Officer pending hearing and determination of the case.

Justice Lady Hellen Wasilwa issued the orders after embattled Chief Executive Officer Angela Ndambuki moved to court seeking to stop any appointment in her position as the board boss.

Through lawyer Wambua Kilonzo, she pleaded with the court to block Kenya National Chamber of Commerce and Industry from discussing or making any decision on the employment of the purported termination of her position as the Chief Executive Officer of the board in a meeting scheduled on 14 of June 2018.

She further urged the court to maintain the  status quo to allow her to continue serving as the Board CEO and discharge her duties as per the Employment Agreement between the two parties.

“Court be pleased to issue conservatory order maintaining the status quo ante the respondent’s letter of 22 May, 2018 by allowing the applicant to continue in her position as the executive officer of the respondent and to discharge her duties under Employment Agreement between applicant and respondent dated 1 October, 2017” said Angela.

Angela also seeks the board to be barred from making any appointment or conducting any recruitment aimed at filing the position of CEO.

She argues on 22 of May this year, Kenya National Chamber of Commerce and Industry purportedly to have terminated her employment as the Board CEO.

In a letter dated 22 of May ,2018 , the National Chairman of the respondent purported to terminate employment of Angela Ndambuki as the CEO.

“There is no decision or resolution of the respondent’s Board of Directors sanctioning the termination and respondent disregarded laid down procedure under respondent’s Human Resource Policy and Procedure Manual” court papers state.

She further claimed after the alleged termination of employment, the respondent has appointed George Kiondo in the acting capacity to replace Angela.

She argued that the application if not heard urgently and measures of protection issued, the respondent will proceed to confirm the applicant’s of the said replacement jeopardizing the chances of applicant on the same position.
