Two suspects alleged to have shot former Garissa County official have been released of a cash bail of Sh 500,000 and bond of 1 million each.
This is after the Chief Magistrate upheld the earlier bond terms issued before overturned by high court after the victim sought review of the the magistrate decision to release them on bond.
Chief Magistrate Francis Andayi ruled that neither Mohamud Hussein Aden nor Juliet Charity Njoki are flight risks or a threat to witnesses.
“In the circumstances above and the probation report, I find no reason to deny the accused persons bail,” Ruled Andayi CM.
Kanjama and the family rejected the first probation report and moved to the High Court on grounds that serious issues of consideration that should guide the court in determining the bail application were not considered.
Lady Justice Ngenye Macharia temporarily suspended the magistrate decision and directed that a comprehensive probation report be tabled before the trial court in two weeks.
The accused Mohamed Hussein Aden and Juliet Njoki gained their freedom after probation report gave indication that they are not flight risk.
Chief Magistrate Francis Andayi, said that prosecution and counsel for the victim of the shooting did not demonstrate that the two could interfere with witnesses or abscond trial.
He said a part from the cash bail the accused should each provide bond of Sh 1 million with two sureties and deposit their passports in court.
The trial Magistrate further said that the accused should not interfere with witnesses when this matter is still pending in court.
The second accused lawyer Dunstan Omari, said their clients have been in police custody for long in which police have carried their investigation in regard to the alleged shooting.
